# Three Events on One Day: ChatGPT Advertising, GenAI.mil, and the Askell Profile

On February 9, 2026, three events landed on the same date. OpenAI began serving advertisements to free-tier and Go ($8/month) ChatGPT users. The Department of Defense announced integration of a custom ChatGPT into GenAI.mil, an enterprise platform for 3 million personnel, running on isolated government cloud with no commercial data sharing. The Wall Street Journal published a profile of Amanda Askell, Anthropic's behavioral guidelines author.
A custody surface is the set of records an AI system generates during operation that can be discovered, subpoenaed, or compelled through legal process. An interaction record is the log of what a user asked, what the system responded, and any reasoning the system performed. The structural contrast across these three events is worth examining.
The military deployment runs on isolated infrastructure with no commercial data access. The consumer deployment now includes advertising and operates under terms that a federal judge subsequently held defeat confidentiality expectations. GenAI.mil demonstrates that isolated cognitive environments are technically feasible and already deployed for high-stakes contexts. The advertising launch demonstrates that consumer platforms are monetizing the cognitive interaction environment, with the advertising model depending on the retention of interaction data that makes ad targeting possible.
Askell's profile generated public debate about who controls what AI says to users, but no corresponding discussion of what happens to what users say to AI. The behavioral governance question (how should the model act?) dominated public attention. The record governance question (what happens to the records the model generates during every interaction?) received none.
The juxtaposition on a single date captures the two-tiered system that independent academic analysis subsequently confirmed: military and enterprise users receive isolated, non-commercial cognitive environments, while consumer users interact through an advertising-supported platform whose business model depends on retaining the interaction records the governance debate does not address.
